A U.S. District Court judge found the Border Patrol violated constitutional rights during unauthorized arrests of farm workers in the Central Valley. The case arose from a raid in Bakersfield, where agents detained individuals without reasonable suspicion, prompting federal legal action led by the ACLU. The judge ruled that the Border Patrol's conduct breached established rights and ordered them to stop warrantless stops. A class action suit is allowed, and the agents must provide training guidelines and documentation on their actions.
"The evidence before the Court is that Border Patrol agents under DHS authority engaged in conduct that violated well-established constitutional rights," she wrote.
"This sends a powerful message that the raids Border Patrol conducted in and around Kern County in January were illegal," said Bree Bernwanger, an attorney at ACLU Foundation of Northern California.
