Genki displayed a mockup of the Switch 2 at CES 2025 and claimed design access to unrevealed Nintendo hardware. Nintendo filed a trademark infringement lawsuit in May in response to the promotional stunt and related marketing. The parties reached a confidential settlement ordered on September 8 that includes monetary payment and permanent injunctive terms. Genki is barred from using specified terms and any similar approximations of Nintendo intellectual property for accessories marketed for use with Nintendo products. Genki must ensure packaging, product designs, and descriptions clearly state its unlicensed accessory status and avoid rebranding that mimics Nintendo marks.
