In a recent conversation on IPWatchdog Unleashed, Ed Russavage and John Strand from Wolf, Greenfield & Sacks, PC discussed the complexities of intellectual property risk in the context of AI. Companies, primarily mid-sized to large, are looking to leverage AI for data enhancement but are wary of IP risks associated with open AI tools. Russavage emphasized the importance of aggressive patent strategies, urging clients to file patents early, often using provisional applications to safeguard innovations. They advised focusing on long-lasting innovations to navigate the rapid changes in the AI landscape.
"It's a lot of wait-and-see unfortunately," Strand said. "The companies that have come to us for risk assessments mostly are mid-sized to larger companies that are very data heavy driven companies looking to use AI."
"We just tell folks file early file often and try to file something good. We use a lot of provisionals these days. Filing them within weeks or months not years..."
"We do pick things that have a longer sense of time. Like user interface aspects or an API. It's complicated in AI due to its rapid evolution.”
