CAFC Reverses Equitable Estoppel Ruling After Finding No Reliance by Sirius XM Radio

The U.S. Court of Appeals for the Federal Circuit reversed a District of Delaware ruling which had barred Fraunhofer from claiming patent infringement against Sirius XM. The court determined that while Fraunhofer’s lengthy silence constituted misleading conduct, Sirius XM failed to demonstrate that it relied on that silence in its decisions. The case stems from a patent infringement complaint filed by Fraunhofer long after its collaboration with XM, following a complex interplay of licenses and a significant delay in asserting rights regarding its technology.
'Fraunhofer's more-than-five-year silence in asserting infringement...rose to the level [of] misleading conduct,' said the CAFC.
Sirius XM did not establish the required element of reliance on Fraunhofer's misleading conduct.
The Federal Circuit reversed the District of Delaware's grant of summary judgment barring Fraunhofer from pursuing patent infringement claims.
The present appeal stems from a complaint for patent infringement filed by Fraunhofer in February 2017, nearly 20 years after Fraunhofer first began collaborating with XM Satellite Radio.
