Drake to Appeal "Not Like Us" Lawsuit Ruling
"This confirms our intent to appeal, and we look forward to the Court of Appeals reviewing that filing in the coming weeks."
"lost a rap battle that he provoked and in which he willingly participated."
"the broader context of a heated rap battle, with incendiary language and offensive accusations hurled by both participants, would not incline the reasonable listener to believe that 'Not Like Us' imparts verifiable facts."
Drake and his legal team filed a notice of appeal in a New York federal court on October 29 seeking to revive his dismissed lawsuit against Universal Music Group. Drake originally sued UMG in January, accusing the company of promoting Kendrick Lamar's diss song 'Not Like Us' and alleging the song was defamatory. UMG moved to dismiss, arguing Drake provoked and willingly participated in a rap battle and lost. Judge Jeannette A. Vargas granted dismissal, finding the rap-battle context would not lead a reasonable listener to believe the song conveys verifiable facts. UMG has not immediately responded to requests for comment.
