Man charged with attempted rape of person who died on a New York City subway train

Felix Rojas, 44, faces charges of attempted rape and attempted grand larceny after surveillance footage captured him performing sexual acts on an unconscious passenger on a subway train. The victim, who boarded the train earlier, was found motionless hours later and subsequently declared dead. Assistant District Attorney stated that Rojas exploited the victim’s state. Rojas was arraigned after his arrest three weeks post-incident and is currently detained as investigations continue, with no plea entered yet from his public defender’s office.
After seeing that the victim continued to remain motionless, the defendant decided to take advantage of the situation,” Assistant District Attorney Antonio Melchionna said during the arraignment.
The public defender's office representing him said it was looking into the circumstances of the case and did not comment further.
