The Department of Justice has withdrawn its support for a transgender inmate, identified as Jane Doe, in her legal battle for gender-affirming care while incarcerated in Georgia. This lawsuit, citing violations of the Americans with Disabilities Act and constitutional rights against cruel punishment, alleges that the Georgia Department of Corrections provided inadequate care, worsening Doe's severe gender dysphoria. Notably, clinicians have recommended surgery, yet the inmate's cries for help have gone unheeded, leading to dire mental health consequences, including self-harm and suicide attempts, as noted by the Biden DOJ.
GDC has refused to treat Ms. Doe despite her severe and overwhelming gender dysphoria, which includes two castration attempts, multiple suicide attempts, and almost daily self-harm.
Because of the inadequate care and exacerbation of her gender dysphoria, Doe has engaged in repeated self-harm, including attempts at suicide and self-castration.
The Biden DOJ noted that gender dysphoria is a serious medical condition that, left untreated, can result in significant adverse mental health outcomes.
The DOJ under President Biden issued the statement of interest in the case last year, saying the GDC had violated the ADA as well as the constitutional rights.
