"It's the latest step in a legal battle widely expected to land before the Supreme Court, with James squaring off against another high-profile state attorney general, Texas's Ken Paxton (R). The case centers on New York's "shield" law, which allows doctors to remotely prescribe and mail abortion pills to patients nationwide, even in states that ban abortion. New York is one of eight Democratic-led states that have enacted such laws in an attempt to safeguard abortion access beyond their borders."
New York Attorney General Letitia James will defend a county clerk who twice refused to enforce a Texas court judgment ordering a New York doctor to stop prescribing and mailing abortion pills to Texas patients and to pay a $113,000 fine. The Texas suit, filed by Attorney General Ken Paxton in December 2024, led a Texas judge to issue the order. New York's shield law allows doctors to remotely prescribe and mail abortion pills nationwide and prohibits New York officials from assisting in the enforcement of out-of-state abortion judgments. Paxton sued the county clerk in late July, and the matter is widely expected to reach the Supreme Court.
