"Though two lower courts ruled that ICE's actions are likely illegal, Justice Brett Kavanaugh wrote the majority opinion, which included the following: "The Immigration and Nationality Act authorizes immigration officers to 'interrogate any alien or person believed to be an alien as to his right to be or remain in the United States.'" Justice Sonia Sotomayor wrote the dissent, joined by Justice Elena Kagan and Justice Ketanji Brown Jackson."
The Supreme Court's 6-3 decision temporarily suspended lower-court orders that limited ICE from detaining people based on ethnicity, language, or job type. ICE carried out immigration sweep operations across Southern California, focusing on swap meets, taco trucks, food stands, car washes, and big-box parking lots and appearing to target Latino-majority communities. Two appellate and federal courts previously ruled such raids were tantamount to racial profiling and likely illegal. The majority opinion cited statutory authority for immigration officers to interrogate individuals. The raids have driven closures of food businesses, including a San Bernardino street food operation and an Arts District restaurant.
