ICE arrest of student was 'unconstitutional racial profiling,' family alleges in claim
"conduct of ICE agents and Border Patrol agents that caused the false arrest, false imprisonment, assault, [and] battery"
"The ICE agents and Border Patrol agents falsely claimed that [the student] was a suspect of a crime,"
"However, this was false and ICE and Border Patrol agents racially profiled [the student] while he was merely sitting his car waiting for his family member. [The student] is a severe special needs young man who was not the suspect of a crime."
Attorneys filed a $1 million damage claim against the Trump administration for the Aug. 11 arrest of a 15-year-old U.S. citizen outside Arleta High School. The claim cites "conduct of ICE agents and Border Patrol agents that caused the false arrest, false imprisonment, assault, [and] battery." The claim was submitted to DHS, Border Patrol, Customs and Border Protection, and ICE. School officials say agents drew weapons and handcuffed the student, who has a disability, and released him only after his mother convinced agents he was not the person sought. The administration denied wrongdoing and racial profiling while acknowledging mistaken identity. A denied claim allows parties to pursue litigation.
