The filings were submitted by Friends of the Everglades, the Center for Biological Diversity, and the Miccosukee Tribe. The records cited include a June 20 email showing an agreement to allow FDEM to detain noncitizens using federal Section 287(g) authority and documents showing Florida applied for and received federal grant funding in August. Defendants including DHS have maintained the facility was state-run by FDEM. A finding of federal action would trigger mandatory NEPA environmental review. The Miccosukee Tribe continues its legal challenge amid a presidential veto affecting tribal control over Everglades lands.
