US court blocks federal judge's National Guard order DW 06/13/2025
Briefly

An appeals court has halted a ruling that mandated President Trump to relinquish control of National Guard troops to California Governor Gavin Newsom. This comes after Judge Charles Breyer deemed the troops' deployment unlawful, arguing it overstepped Trump's authority and violated the Tenth Amendment. Newsom argued that this ruling serves as a national check against Trump's increasing autocratic tendencies. The White House, however, labeled Breyer's decision as unprecedented and claimed it jeopardizes federal officials' safety, asserting that the court cannot override the President’s role as Commander in Chief.
"His actions were illegal both exceeding the scope of his statutory authority and violating the Tenth Amendment to the United States Constitution," Breyer wrote in his decision.
"This win is not just for California, but the nation. It's a check on a man whose authoritarian tendencies are increasing by the day," the governor said on X.
The White House had called Breyer's order "unprecedented" and said it "puts our brave federal officials in danger."
"The district court has no authority to usurp the President's authority as Commander in Chief," White House spokesperson Anna Kelly said.
