Small businesses and states challenging the tariffs agreed to the fast schedule, alleging illegal use of emergency powers to set import taxes on goods from almost every country and near-bankruptcy of affected businesses. The court will also hear a separate challenge from Learning Resources. Two lower courts found most tariffs illegally imposed while a 7-4 appeals court left them temporarily in place. The levies stem from a trade war, generated $159bn by late August, and raise questions about expansive presidential authority.
