He noted that there were ongoing deportations as the decision was issued, with flights en route to El Salvador. The administration's inadequate responses to the court's order led to this grave determination of probable cause for criminal contempt.
When the court issued the order, two planes of Venezuelans were on their way from the United States to El Salvador and had not returned to the United States.
The Court does not reach such conclusion lightly or hastily; indeed, it has given Defendants ample opportunity to rectify or explain their actions. None of their responses has been satisfactory.
