Anofils was driving recklessly and at a high rate of speed when he struck 82-year-old Austin Noel, who was crossing the street at approximately 3:40 a.m.

"The defendant allegedly transformed his vehicle into a deadly weapon to carry out a violent and alarmingly fatal act," Tierney said. "This particularly dangerous escalation of violence is one our office takes very seriously."

"To say that their BAC's may have contributed to the cause of death is a reach to say the least," Assistant Prosecutor Michael Mestern argued.

Smilianska was charged four-and-a-half months following the July 29, 2023, crash by the Longmont Police Department with reckless vehicular homicide.
