The European Court of Justice ruled that EU member states must provide identification documents reflecting transgender citizens' lived gender identity rather than their gender at birth. Bulgaria's Supreme Court of Cassation had referred the case after lower courts denied changing a transgender woman's documentation. The ECJ determined that documents not reflecting lived gender cause considerable inconveniences during travel and daily situations. The court emphasized that EU law supersedes national legislation, stating member states cannot restrict gender data amendments for citizens exercising freedom of movement rights. The ruling impacts other EU nations like Hungary and Slovakia that previously refused issuing documents reflecting anything other than birth gender. The case returns to Bulgarian courts to establish procedures for providing appropriate documentation.
