Attorneys for Partners in Animal Care & Compassion sent San Jose a formal demand letter Jan. 13 alleging violations of state civil and penal codes related to humane animal care and giving the city until Jan. 31 to respond before pursuing litigation. The firm documents instances of animals suffocating during routine surgeries and of animals arriving in need of urgent medical care who are not receiving it. The letter alleges animals were left without food or water, unmonitored after surgery, handled in ways that violate safety and "fear-free" principles, and that the city may be violating the Hayden Act by euthanizing treatable, adoptable animals such as cats with ringworm. Advocates say concerns have been raised for more than three years while implementing a national dog enrichment program.
