German tourist sues NYC's Los Tacos No. 1 over salsa being too spicy
"As I had no idea about the components of the sauce, no experience before and no warning information was mentioned on the sauce cup, I put a lot of sauces in the taco. Almost instantly I learned that the green salsa is a very hot spicy one."
"For someone like me living in Germany and eating nothing spicy, it was a very big shock physically and mentally. It is practically forbidden for me to eat such a very hot spicy food."
"When it comes to salsa, the spice is often the point. The judge also noted that the complainant continued with his visit to the city including attending the U.S. Open without issue."
A German tourist visiting New York City in August 2024 sued Los Tacos No. 1 after consuming their green salsa, which he claimed caused severe physical reactions including diarrhea, nausea, mouth and tongue blisters, and elevated heart rate. The tourist alleged he had no warning about the salsa's spiciness and requested $100,000 in compensation for medical expenses, pain, suffering, and emotional distress. He argued the restaurant should have warned him despite not asking staff about the salsa's heat level. The judge dismissed the case, stating that spiciness is inherent to salsa and noting the plaintiff continued his NYC activities without issue afterward.
