"After his release, one of the alleged victims, Jeffrey Damnit, asked prosecutors to upgrade LaBeouf's charges, accusing the Holes star of lobbing homophobic slurs at him. During Thursday's hearing, Levine noted that the additional accusations have since been entered into court record."
"She relayed her biggest concern was the possible danger LaBeouf poses not only to his alleged victims, but to the wider community as a whole, in particular the 'marginalized community' that has faced so much 'terror.'"
"While his attorney Sarah Chervinsky insisted the results did not show her client under the influence of alcohol or any illegal substances, Levine still expressed worry that the test results showed that the actor 'does not take his alcohol addiction seriously.'"
Shia LaBeouf appeared in New Orleans Criminal District Court where Judge Simone Levine set his bail at $100,000 and imposed additional conditions following his arrest for allegedly attacking two bartenders. Originally charged with two counts of simple battery and released on his own recognizance, one alleged victim requested prosecutors upgrade charges to include homophobic slurs. The judge expressed concern about danger LaBeouf poses to alleged victims and marginalized communities. Beyond bail, LaBeouf must undergo mandatory treatment and drug testing. Despite his attorney's assertion that drug and alcohol tests showed no intoxication, the judge noted concern that test results indicate LaBeouf does not take his alcohol addiction seriously. Travel outside New Orleans was prohibited pending case resolution.
