Trump Takes Education Department Lawsuit to Supreme Court

The Trump administration has petitioned the Supreme Court to permit the reduction of nearly half of the Education Department's workforce, aiming to dismantle the agency. A federal district court previously ruled this move would hinder the executive's ability to fulfill congressionally mandated programs, an opinion affirmed by an appeals court. Solicitor General John Sauer argues that the executive branch should determine necessary staffing for agency functions. States, school districts, and teachers' unions will respond to this appeal by June 13, pending the court's decision.
The Constitution vests the Executive Branch, not district courts, with the authority to make judgments about how many employees are needed to carry out an agency's statutory functions, and whom they should be.
In late May, a federal district court ruled that the reduction in force made it impossible for the executive branch to carry out congressionally mandated programs and services.
