In a motion filed on Wednesday, the plaintiffs' counsel wrote that NAR's decision to change its MLS policies was essentially NAR admitting that those requirements are a violation of antitrust law. This admission is critical to the issues raised by Plaintiffs in their complaint and rebut the Defendants' arguments that the previous policy of the NAR requiring membership in its organization in order for brokers and agents to access the MLS did not violate antitrust law and were not wrongful, the filing states.
As NAR charts a new path and as part of our strategic efforts to continue to add and prove value to Realtors, we are transforming our events business to be a bigger and more inclusive space for industry leaders and practitioners to convene and help define the future of real estate, Nykia Wright, the CEO of NAR, said in a statement.
REX's legal saga began in March 2021, two months after Zillow began moving homes not listed on the MLS out of initial user search results and onto a second tab, in adherence with NAR's optional no-commingling rule.
